Welcome to www.iconnel.org (the “Site”), operated by Iconnel Catholic Foundation Inc. (“Iconnel,” “we,” “us,” or “our”), a 501(c)(3) tax-exempt public charity incorporated in New York and dedicated to preserving Polish Catholic culture and providing senior care companion placement services.
By accessing or using the Site, making a donation, submitting an inquiry, or registering as a caregiver or client, you agree to be legally bound by these Terms and Conditions (“Terms”). If you do not agree, you must immediately cease all use of the Site and refrain from making any donation or submission.
1. Use of the Site You may use the Site only for lawful, personal, and non-commercial purposes. You agree not to:
violate any federal, New York State, or local law;
use any robot, spider, scraper, or other automated means to access the Site without our prior written consent;
introduce viruses, malware, or any other harmful code;
interfere with the Site’s security, functionality, or infrastructure;
impersonate any person or entity; or
post or transmit harassing, discriminatory, defamatory, or illegal content.
2. Intellectual Property All content on the Site (text, images, logos, videos, etc.) is owned by Iconnel or its licensors and protected by U.S. and international copyright, trademark, and other laws. You may view and print pages for personal, non-commercial use only, provided you retain all copyright and proprietary notices. Any other use, including reproduction, distribution, or creation of derivative works, requires our prior written permission. Our name, logo, and all related marks are trademarks of Iconnel and may not be used without express written consent.
3. User Content and Submissions By submitting information (e.g., donation details, service inquiries, caregiver applications, or testimonials), you grant Iconnel an irrevocable, royalty-free, worldwide license to use, copy, modify, display, and distribute the content for our charitable mission. You represent and warrant that your submissions are accurate, do not violate third-party rights, and do not contain viruses or harmful code. We may remove or refuse any submission at any time, for any reason, without notice or liability.
4. Companion Placement Services We connect seniors and families with caregivers who share Polish Catholic values. Iconnel is not an employer, employment agency, or household employer. Any placement creates a direct, private employment or contractual relationship between the client and caregiver. We make no guarantees regarding the suitability, performance, background, or conduct of any caregiver. Clients are solely responsible for screening, hiring decisions, wages, taxes, and compliance with employment laws.
5. Donations
5.1 Tax-Deductible Contributions Iconnel Catholic Foundation Inc. is a 501(c)(3) public charity (EIN available on request). Contributions are tax-deductible to the fullest extent allowed by law. Donors giving $250 or more will receive a contemporaneous written acknowledgment as required by the IRS.
5.2 Designation and Use of Funds Unless we expressly accept a restricted purpose in writing, all donations are unrestricted and may be used at our sole discretion for any charitable purpose, including programs, administration, and overhead. If a restricted gift cannot be used as designated, we may redirect it to a similar purpose or contact you for alternate instructions, in accordance with IRS rules.
5.3 No Goods or Services Unless explicitly stated otherwise, you receive no goods or services in return for your donation. If any benefit is provided, its fair market value will be disclosed, and only the excess is tax-deductible.
5.4 Recurring Donations By selecting recurring donations, you authorize us to charge your chosen payment method on the selected schedule until you cancel or modify the donation through your donor account or by emailing donations@iconnel.org. Changes take effect the next billing cycle.
5.5 Refunds Donations are generally non-refundable. We may, in our sole discretion, refund a donation within 30 days of receipt in cases of clear processing error or unauthorized charge, consistent with IRS guidelines and New York law.
5.6 Payment Processing & Security Donations are processed by PCI DSS-compliant third-party providers. We do not store full credit-card numbers on our servers.
5.7 Donor Recognition & Anonymity We may publicly recognize donors and amounts unless you request anonymity at the time of donation.
6. Privacy Your personal information is governed by our Privacy Policy, which complies with the New York SHIELD Act and other applicable data-protection laws. By using the Site, you consent to our collection, use, and disclosure practices described therein.
7. Disclaimers THE SITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or compatible with your device. Information on the Site is for general informational purposes only and is not medical, legal, or professional advice.
8. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICONNEL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, even if advised of their possibility. Our total liability to you shall not exceed the greater of (a) $100 or (b) the amount you paid us in the past 12 months. These limitations do not apply to liability for death, personal injury, gross negligence, or willful misconduct where prohibited by law.
9. Indemnification You agree to defend, indemnify, and hold harmless Iconnel and its officers, directors, employees, volunteers, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, violation of these Terms, or violation of any third-party rights.
10. Copyright Complaints (DMCA) We respect intellectual property rights. To report alleged infringement, please send the information required by 17 U.S.C. § 512(c)(3) to our designated agent: info@iconnel.org or the address below. Counter-notifications may be submitted under 17 U.S.C. § 512(g).
11. Governing Law; Dispute Resolution These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-law principles. You agree that any dispute shall be resolved exclusively in the state or federal courts located in New York County, New York. You waive any right to participate in class actions or representative proceedings.
12. Changes to Terms We may update these Terms at any time. Material changes will be posted on this page with a new “Last Updated” date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
13. Miscellaneous
Force Majeure – We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, war, pandemics, cyberattacks).
Accessibility – We strive to make the Site accessible in accordance with WCAG 2.1 AA and Title III of the ADA.
International Users – The Site is controlled and operated from the United States and is not intended for persons subject to jurisdictions that prohibit charitable solicitations from U.S. organizations.
Electronic Communications – By using the Site, you consent to receive electronic communications from us. Your acceptance of these Terms constitutes an electronic signature with the same effect as a handwritten signature under the E-SIGN Act.
Assignment – We may assign these Terms without notice; you may not assign them without our written consent.
Severability & Waiver – If any provision is held invalid, the remainder remains in full effect. No waiver of any term shall be deemed a further or continuing waiver.
Entire Agreement – These Terms, together with the Privacy Policy, constitute the entire agreement between you and Iconnel.
Survival – Provisions that by their nature should survive (e.g., indemnification, disclaimers, liability limits) will survive termination.
